Terms of sale and Guarantee

I.  Dog( s) come with a one year guarantee against hip and elbow dysplasia from date of birth.

2.  Above dog(s) is/are guaranteed by seller Pine Creek Ranch Dutch Shepherds (hereinafter known as "PCR Dutch Shepherds") to be healthy", free of parasites, and crippling dysplasia (grades 4 & 5). * A healthy animal is that which other members in the same profession selling the same type of animal would consider healthy. PCR Dutch Shepherds can not make any claims as to dog(s) ultimate size, coloring, look, weight, etc., as these factors are out of PCR Dutch Shepherds control and also are influenced by outside variables.

3. If dog(s) has/have any health problems within 72 hours of Buyer receiving dog(s), or a longer period of time if noted here __ (hours), dog(s) MUST be brought back immediately to PCR Dutch Shepherd's Veterinarian, Evan Yardley D.V.M. (hereinafter known as VET). VET will examine, treat, and cure Buyer's dog(s). All VET bills and boarding free of charge to Buyer. If dog(s) cannot be cured to full health and/or the dog(s) illness is due to a genetic defect, Pine Creek Dutch Shepherds will REPLACE** dog(s). If same sex and color etc. are not then available, Buyer will have to wait as long as it takes to get replacement dog(s) or opt to pick out different dog(s) at an earlier time when availability occurs.                                                                          .

4. If dog(s) has any health problems and Buyer takes dog(s) to a different Veterinarian than VET, PCR Dutch Shepherds is not responsible for any payments or bills in any event to Buyer's chosen Veterinarian.

5. Dog(s) temperament or emotional disposition is not guaranteed in any way unless PCR Dutch Shepherds trains and monitors dog(s) for the first fourteen months of dog(s) life.

6. Dog(s) CANNOT be spayed or neutered for one year from date of birth or the guarantees within this contract are null and void. Any illness of any kind resulting from a successful, unsuccessful, or attempted neuter or spay will also make all guarantees within this contract null and void.

7. Buyer understands PCR Dutch Shepherds will exercise due diligence in providing all AKC or other registration papers but will not be responsible for any delay in Buyer's receipt of such within one year.

8 .** REPLACE (SEE POINT 3 ABOVE). Buyer understands that there will be NO REFUNDS whatsoever at any time after delivery of dog(s) and the sole remedy for Buyer's dissatisfaction under the terms in this contract are a REPLACEMENT dog(s). The express written terms within this contract supersede any other verbal statements, promises, or opinions whether before or after this contract is signed.

9. Buyer is deemed to have taken delivery of dog(s) at the time of the signing of this document, or has made prior arrangements for shipping and paid $250 NON REFUNDABLE deposit.

10. THE EXPRESS WRIITEN WARRANTIES WITHIN THE CONFINES OF THIS CONTRACT FOR SALE OF DOG(S) SUPERCEDE AND TAKE PRECEDENCE OVER ANY OTHER EXPRESS OR IMPLIED WARRANTIES OF ANY KIND WHATSOEVER AND THE BUYER'S SOLE REMEDIES UNDER THIS CONTRACT ARE STATED ABOVE.

WAIVER OF LIABILITY

I understand that any mishandling or improper care by myself or anyone appointed by me to care for, handle, or train __________ (name of dog) by any other than PCR Dutch Shepherds releases: PCR Dutch Shepherds, Sher Yardley, Robert Yardley, Crystal Hall, or any other handler at Pine Creek Ranch Beaver UT from any liability. Also that I am required to attend 8 hours of training with the dog to learn proper handling. Any violation of the above conditions will terminate contract and guarantee will not be honored.

I have read and understand the entire contract above as well as the terms within. I have initialed each numbered point to declare that I have read and understood that term. I understand there are no refunds, only replacement dog(s) as set above in points 3 and 8. If I had questions regarding this document I have already asked and was answered to my satisfaction before I sign below.
